WASHINGTON (AFP) - A California lawyer has filed a class action lawsuit against French wine producers and a US importer over the sale of millions of bottles of wine falsely passed off as Pinot Noir.

"A class action complaint has been filed seeking to represent all California consumers who purchased falsely labeled wine," said Brian Levine, an attorney with California law firm Kingsley and Kingsley.

The complaint accuses the defendants of "false advertising, unfair business practices, fraud, negligent misrepresentation, (and)... unjust enrichment."

The lawsuit does not specify the amount of damages being sought.

The filing comes after a French court handed down suspended jail terms and hefty fines to 12 people for selling 18 million bottles (135,334 hectoliters) of wine presented as Pinot Noir that was in fact made from far cheaper grape varieties.

Those convicted included executives from wine estates, cooperatives, a broker, wine merchant Ducasse and the conglomerate Sieur d'Arques.

The mislabeled wine was sold in the United States under E & J Gallo's popular "Red Bicyclette" Pinot Noir label, which in 2006 was marketed as having "aromas of dark fruit flavors" and whose palate was said to be like "black cherry and ripe plum."

It is not yet clear whether Gallo purchased the wine at a lower price than the market rate for Pinot Noir.

According to US officials, Constellation Brands, the world's biggest wine group, was also the recipient of some of the 18 million bottles of fake Pinot Noir.

TOKYO (AFP) - Japan's top Internet forum 2channel was offline Tuesday after an apparent mass hacker attack from South Korea over slanderous comments on their Olympic figure skating queen Kim Yu-Na.

South Korea's Yonhap news agency reported that more than 10,000 users had launched a "concerted cyber offensive" and coordinated their attacks through web communities since Monday against the popular site www.2ch.net.

The site, launched in 1999, allows users to post comments on hundreds of topics, from politics and sports to entertainment and manga cartoons, without providing a user name, a model meant to boost online freedom of speech.

But the site has repeatedly become a forum for right-wing nationalists and users posting xenophobic slurs, especially against South Korea and China.

The 2ch forum is Japan's largest online bulletin board by number of users and page views, according to Internet research firm NetRatings Japan.

The site was not accessible on Tuesday, but its search lists showed Japanese-language attacks had earlier been posted against Kim, who beat Japanese rival Mao Asada to take gold at the Vancouver Winter Games.

South Korea's JoongAng Daily reported online that the cyber war was launched on Monday, the anniversary of a 1919 uprising against Japanese colonial rule that became known as the March First Movement.

South Koreans have often been angered by comments on the messaging forum, including one that called a deadly attack against a South Korean college student in February in Irkutsk "Russia's good deed", Yonhap reported.

The 2ch forum has often drawn controversy at home as some of its anonymous users have posted death threats and verbal attacks against high-profile figures that have led to legal action against the site's operators.

WASHINGTON (Reuters) - Many Americans believe they have lactose intolerance and thus avoid dairy products, but no one really knows whether they are damaging their health, experts told a national conference on Wednesday.

In fact, no one has even done the research needed to tell how many people have actual lactose intolerance, which makes it difficult or impossible for them to digest milk, cheese or yogurt, the experts told a "consensus conference" at the

National Institutes of Health, a meeting called to define the state of science.

"I think that there are huge gaps in knowledge," Dr. Frederick Suchy of the Mt. Sinai School of Medicine in New York, who led the meeting, told a news conference.

"There is a huge amount of research that needs to be done."

And while there is a great deal of worry that people who avoid dairy are missing out on calcium and vitamin D that can keep their bones strong, minimize high blood pressure and perhaps even prevent some cancer, there is no evidence this is in fact the case, Suchy said.

Many new products claim to help people with lactose intolerance drink milk without bloating, cramps, diarrhea and other ill effects but no one has studied those, either, Suchy said.

Calcium and vitamin fortified orange juice, soy milks and other products should, in theory, provide the nutrients, he said.

"Although dairy foods are an excellent source of calcium, vitamin D, protein, magnesium, potassium, riboflavin, and other nutrients, these individual nutrients are available in other foods, fortified foods, and supplements," the final report from the conference reads.

People who think they must avoid all dairy products may not need to, the researchers said in their report.

"The available evidence suggests that adults and adolescents who have been diagnosed with lactose malabsorption could ingest at least 12 grams of lactose (equivalent to the lactose content found in 1 cup of milk or 1 cup of yogurt) with no or minor symptoms," the report reads.

It calls for more research into the issue.

"Despite the widespread belief that decreased vitamin D and calcium intake associated with restricted intake of dairy products will lead to poor health outcomes, particularly related to bone mineral density and risk for fractures, few data are available on bone health in individuals with lactose intolerance and dairy avoidance," it reads.

"Future studies should investigate the association between dietary calcium intake and outcomes in people with lactose intolerance on low-lactose diets."

Most human babies are born with the ability to digest milk, but a genetic mutation allows people of mostly northern European descent to continue to eat and drink dairy products into adulthood with no unpleasant side-effects.

Conditions range from true lactose intolerance to lactose malabsorption, which is an inability to completely digest milk products.

NEW YORK (Reuters Life!) - World travel can make anyone sick but men and women tend to suffer different illnesses with women more prone to stomach problems and men at higher risk of fevers and sexually transmitted diseases, Swiss researchers found.

A study of almost 59,000 international travelers by the University of Zurich found women were more likely than men to come down with bouts of diarrhea or other gastrointestinal problems, colds, urinary tract infections and adverse reactions to medications, such as those taken to prevent malaria.

Men had higher risks of fever, including from infections transmitted by mosquitoes, ticks or other such "vectors," such as malaria, dengue and rickettsia.

Men were also more likely than women to be treated for mountain sickness, frostbite or sexually transmitted diseases.

Researcher Dr. Patricia Schlagenhauf said the findings, published in the journal Clinical Infectious Diseases, offer travelers and travel-medicine specialists a clearer idea of how to prepare for international trips.

For example female travelers should be especially sure to bring anti-diarrheal medication.

While all travelers need advice on preventing mosquito-borne illnesses like malaria, the researchers said men may need to pay particular attention to preventive measures, like frequently reapplying insect repellent.

The findings were based on data from 44 travel-medicine clinics throughout the world, all of which are part of a surveillance network designed to track travel-related ills and injuries.

Schlagenhauf and her colleagues looked at records for 58,908 patients who visited those clinics between 1997 and 2007.

Of 29,643 women, one-quarter were treated for acute diarrhea, compared with 22 percent of men.

But when other factors were considered -- like the length and destination of the trip -- women were anywhere from 13 percent to 39 percent more likely than men to seek treatment for diarrhea or symptoms of irritable bowel syndrome, which include diarrhea, constipation and abdominal pain.

Just over 3 percent of men were treated for malaria, and roughly the same number sought treatment for dengue, which is also transmitted by mosquito.

That compared with rates of 1.5 percent and 1.7 percent, respectively, among women.

Overall, over 17 percent of men had some type of fever-inducing illness, versus 11 percent of women.

The exact reasons for the sex difference are not clear. One possibility, according to the researchers, is that men make "more attractive hosts" to mosquitoes because the insects are lured by sweat and excessive sweating also washes off insect repellent.

As for gastrointestinal ills, women may either be more susceptible to them, or they may be more likely than men to seek treatment for them, according to Schlagenhauf's team.

Just over 1 percent of men visited a travel clinic for a sexually transmitted disease, with men being one-third more likely than women to do so. The researchers said past research has shown that men are more likely than women to have sex with someone they meet overseas.

"Safe sex advice is a missing component in most pretravel practices and our study suggests that male travelers, in particular, would benefit from greater preventive efforts," said the researchers.

BANGKOK (AFP) - Thailand's inflation rose for the fifth straight month in February, showing that the country is recovering from the global economic crisis, the commerce ministry said.

The index rose 3.7 percent year-on-year due to food prices that increased 5.1 percent and non-food sector items that rose 7.7 percent, it said.

"The increase in inflation clearly reflects that the economy has recovered in both the agricultural and industrial sectors," said a ministry statement.

Average inflation in the first two months of this year stood at 3.9 percent, it said.

The ministry maintained its original target for inflation this year at between 3.0 percent to 3.5 percent.

SEOUL (AFP) - South Korea's top automaker Hyundai Motor said Tuesday it is recalling more than 500 Tucson sport utility vehicles in the United States due to potentially defective airbags.

It was the firm's second such announcement in a week, after it said on February 24 it would recall 47,300 of its latest Sonata sedans in the US and the domestic market due to a possible door lock problem.

The firm said the latest action affects 515 "2010 Tucson" units made in South Korea and exported to the US from November 10-30, because their airbags may not work properly for a front-seat passenger.

"Hyundai is voluntarily initiating this action to ensure the safety and quality of vehicles and the continued satisfaction of our customers. Dealers will make the repairs free of charge," it said in a statement.

Hyundai said it sold 2,216 "2010 Tucson" models in the US in January.

The company's US auto sales rose 8.3 percent to 435,064 in 2009, giving it a market share there of 4.2 percent compared to 3 percent in 2008.

Recalls have become a sensitive issue after Japan's Toyota was forced to fix millions of vehicles worldwide.

Toyota president Akio Toyoda on Monday apologised to consumers in China -- days after he said sorry to angry US lawmakers in Washington for faulty accelerator pedals blamed for more than 30 deaths.

NUSA DUA, Indonesia (AFP) - It is blamed for everything from deforestation to threatening the extinction of the orangutan, but palm oil is a vital source of income for many developing countries, the crop's producers say.

In Indonesia, the world's largest palm oil producer, where the plant provides work for three million people, the government is keen to promote the benefits of the crop.

Gatot Irianto, research director at Indonesia's Ministry of Agriculture, pleaded with producers, scientists and NGOs meeting on the holiday island of Bali last week to reconsider the plant's reputation.

"Stop demonising palm oil," he urged. Irianto says palm oil should be considered a "gift from nature" that provides a significant economic boon for the country, where it is "helping to eradicate poverty".

But in many parts of the Western world, and in Europe in particular, palm oil is a byword for ecological disaster; a crop that requires the slashing and burning of vast areas of forest and is a major contributor to global warming.

Nazir Foead, head of WWF Indonesia, said the crop's reputation is deserved because of the way the industry has behaved in recent years.

He says millions of hectares (acres) of tropical rainforest have been razed in Indonesia and neighbouring Malaysia to make way for the palm plantations that make up 80 percent of the world's total.

"But things are changing," he accepts. "Some players have understood that their activity could be linked to deforestation."

Financial pressure has forced at least one big producer to review its business practices after a key partner walked away.

Smart, a leading Indonesian palm-based company, involved in marketing and exporting products such as cooking oil, was dropped by Anglo-Dutch giant Unilever after a Greenpeace report accused it of tropical deforestation.

Daud Dharsono, the company's president, disputes the accuracy of the Greenpeace report, but said the firm had since reaffirmed its commitment to sustainable production to limit the environmental impact of its plantations.

"There will be no conversion on land with high carbon stock as well as land with high biodiversity value, no development on peat soil and primary forests."

For its part, Greenpeace said it was pleased with the commitments, but was now waiting to see action on the ground.

The pressure also comes from big European retailers like Marks and Spencer, which recently launched an anti-palm oil campaign, saying it would use alternatives such as rapeseed oil wherever possible.

The retailer is one of the 400 members of the Roundtable on Sustainable Palm Oil, formed in 2004 to promote sustainable palm oil production.

One of the group's founders, WWF, says dedicated plantations have so far produced over 1.4 million tonnes of certified sustainable palm oil.

Most experts agree that demand for palm products such as cooking oil, margarine, soaps, cosmetics and resins, will continue to increase and better management is the only way to reduce its environmental impact.

"Rapid growth in global demand, notably from China and India, is likely to drive land use change. We cannot change that," said Moray McLeish of the World Resources Institute.

"The solution is an increased utilisation of degraded land," which usually results from deforestation or overgrazing, he said.

Jean-Charles Jacquemard, an engineer at CIRAD, the French Centre for Agricultural Research said palm oil was too profitable for producers in Asia and Africa to abandon, regardless of pressure from the West.

"It is a plant which has many benefits for them. It produces a large amount of oil per hectare, three to six times more than rapeseed or sunflower," he said.

"Its cultivation uses relatively little fertilizer -- around eight kilogrammes (18 pounds) per tree per year."

In Indonesia, 40 percent of production comes from small producers who, by farming between 10 and 20 hectares, "are able to live decently and send their children to university", he said.
